1. Acceptance of Terms

Dusty Enterprise SRL ("Company", "we", "our", or "us") reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service shall be subject to the Terms of Service.

2. Description of Service

The Service provides a digital solution for tracking vehicle trips, managing mileage logs, and generating travel reports. The Service is designed to help individuals and businesses maintain accurate records of vehicle usage for business and personal purposes.

The Company reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. The Company shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Account and Registration

You must provide accurate and complete information when creating your account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify the Company of any unauthorized use of your account or any other breach of security. The Company cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable national or international law or regulation
  • Transmit any material that is defamatory, offensive, or otherwise objectionable
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any automated system to access the Service in a manner that sends more request messages than a human can reasonably produce
5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Dusty Enterprise SRL and its licensors. The Service is protected by copyright, trademark, and other laws of Romania and foreign countries.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

6. User Content

You retain all rights to the data and content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing the Service to you.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that such User Content does not violate any third-party rights.

7. Subscription and Payment

Certain features of the Service may require payment of fees. You agree to pay all fees in accordance with the pricing and payment terms presented to you for such features.

All fees are non-refundable unless otherwise stated. The Company reserves the right to change its pricing at any time, but price changes will not affect your current subscription period.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by discontinuing use of the Service and contacting us to request account deletion.

9. Limitation of Liability

In no event shall Dusty Enterprise SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

The Company does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; or that the Service is free of viruses or other harmful components.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled in the courts of Romania.
